นโยบายคุ้มครองข้อมูลส่วนบุคคล
1. นิยาม
กคม. หมายถึง กองต่อต้านการค้ามนุษย์ สำนักงานปลัดกระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์ กระทรวงการพัฒนาสังคมและความมั่นคงของมนุษย์
โมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” หมายถึง โมบายแอปพลิเคชันที่ กคม. ได้พัฒนาขึ้นในการอำนวยความสะดวกให้กับประชาชนในการแจ้งเบาะแสการค้ามนุษย์ที่พบเห็นในประเทศไทย และการตรวจสอบสิทธิของผู้เสียหายอันพึงได้รับหากตกเป็นผู้เสียหายจากการค้ามนุษย์ รวมถึงการแจ้งความประสงค์ขอล่ามภาษาและการประเมินผลล่าม การอุดหนุนผลิตภัณฑ์จากผู้เสียหายในการสร้างอาชีพระหว่างได้รับการช่วยเหลือ ซึ่งมีให้ใช้งานตั้งในระบบปฏิบัติติการแอนดรอยด์ (Android) และไอโอเอส (IOS)
เจ้าของข้อมูลส่วนบุคคล หมายถึง บุคคลซึ่งเป็นเจ้าของข้อมูลส่วนบุคคล ที่ได้เข้าใช้งานในโมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” ต่อไปในนโยบายฯนี้เรียกว่า “ผู้ใช้งาน” และหรือ “ผู้แจ้งเบาะแส”
ข้อมูลส่วนบุคคล หมายถึง ข้อมูลเกี่ยวกับบุคคลซึ่งทำให้สามารถระบุตัวบุคคลนั้นได้ไม่ว่าทางตรงหรือทางอ้อมตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562
2. วิธีที่ได้มาซึ่งข้อมูลส่วนบุคค
2.1 โมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” ทำหน้าจัดเก็บข้อมูลการแจ้งเบาะแสการค้ามนุษย์ผ่านการกำหนดจุดพบเห็นบนแผนที่ และสถานที่ใกล้เคียง รวมถึงข้อมูลผู้แจ้งเบาะแส ทั้งนี้ข้อมูลผู้แจ้งเบาะแสไม่ได้บังคับการบันทึกหรือต้องให้ข้อมูล หากผู้แจ้งเบาะแสไม่ประสงค์เปิดเผยตัวบุคคล
2.2 ในส่วนที่เป็นการขอล่ามภาษาจะจัดเก็บจำนวนบุคคลที่เป็นล่ามภาษาที่เกี่ยวข้องกับผู้เสียหายจากการค้ามนุษย์ สถานที่ปฎิบัติงาน ข้อมูลเจ้าหน้าที่ผู้ประสานงาน
2.3 การประเมินล่ามภาษาจะจัดเก็บข้อมูลบุคคลที่เป็นผู้ประเมิน และผู้ถูกประเมิน
3. วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล
การประมวลผลข้อมูลที่มีการจัดเก็บ จะเป็นการประมวลผลภาพรวมการแจ้งเบาะแสการค้ามนุษย์ ในรูปแบบแผนที่และงานทางด้านสถิติที่เกี่ยวข้องกับการปรับปรุงล่ามภาษา ข้อมูลส่วนบุคคลไม่ได้นำมาประมวลผลในภาพรวม แต่เป็นการใช้งานเพื่อประสานระหว่างหน่วยงานที่เกี่ยวข้อง เพื่อสิทธิประโยชน์อันพึงมีพึงได้ที่ผู้เสียหายจากการค้ามนุษย์ต้องได้รับ
4. วัตถุประสงค์ในการประมวลผลข้อมูลส่วนบุคคล

6. ระยะเวลาจัดเก็บ และสถานที่จัดเก็บข้อมูลส่วนบุคคล
กคม. จะจัดเก็บข้อมูลส่วนบุคคลตราบเท่าที่จำเป็น โดยคำนึงถึงวัตถุประสงค์ และความจำเป็นในการประมวลผล อันเป็นประโยชน์ต่อผู้เสียหายจากการค้ามนุษย์ รวมถึงประโยชน์ในการประมวลผลสถิติข้อมูลที่เกี่ยวข้องกับการค้ามนุษย์
อนึ่ง กคม. เก็บรักษาข้อมูลส่วนบุคคลของผู้ใช้งานไว้เป็นอย่างดีในที่ตั้ง (on-premise) ซึ่งธำรงไว้ซึ่งความลับ (confidentiality) ตามมาตรการป้องกันด้านการบริหารจัดการ (administrative safeguard) มาตรการป้องกันด้านเทคนิค (technical safeguard) และมาตรการป้องกันทางกายภาพ (physical safeguard) ในเรื่องการเข้าถึงหรือควบคุมการใช้งานข้อมูลส่วนบุคคลประกอบด้วย
(1) การควบคุมการเข้าถึงข้อมูลส่วนบุคคล และอุปกรณ์ในการจัดเก็บและประมวลผลข้อมูลส่วนบุคคลโดยคำนึงถึงการใช้งานและความมั่นคงปลอดภัย
(2) การกำหนดเกี่ยวกับสิทธิในการเข้าถึงข้อมูลส่วนบุคคล เช่น การให้บุคคลที่มีส่วนรับผิดชอบข้อมูลส่วนบุคคลประเภทใดประเภทหนึ่งเท่านั้นที่มีสิทธิในการเข้าถึงข้อมูลดังกล่าว เพื่อเป็นการป้องกันการรั่วไหลของข้อมูลส่วนบุคคล
(3) การบริหารการเข้าถึงของผู้ใช้งาน (user access management) เพื่อควบคุมการเข้าถึงข้อมูลส่วนบุคคลเฉพาะผู้ที่ได้รับอนุญาตแล้ว
(4) การกำหนดหน้าที่ความรับผิดชอบของผู้ใช้งาน (user responsibilities) เพื่อป้องกัน การเข้าถึงข้อมูลส่วนบุคคลโดยไม่ได้รับอนุญาต การเปิดเผย การล่วงรู้ หรือการลักลอบทำสำเนาข้อมูลส่วนบุคคล การลักขโมยอุปกรณ์จัดเก็บหรือประมวลผลข้อมูลส่วนบุคคล
(5) การจัดให้มีวิธีการเพื่อให้สามารถตรวจสอบย้อนหลังเกี่ยวกับการเข้าถึง เปลี่ยนแปลง ลบ หรือถ่ายโอนข้อมูลส่วนบุคคล ให้สอดคล้องเหมาะสมกับวิธีการและสื่อที่ใช้ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล
7. การเปิดเผยข้อมูลส่วนบุคคล
กคม. อาจจะเปิดเผยข้อมูลบุคคลที่เป็นผู้แจ้งเบาะแส ให้เฉพาะหน่วยงานราชการที่มีหน้าที่เกี่ยวข้องในการติดตาม จับกุม และดำเนินคดีในกรณีที่พิสูจน์ทราบแน่ชัดว่ามีการกระทำผิด พระราชบัญญัติป้องกันและปราบปรามการค้ามนุษย์ พ.ศ. ๒๕๕๑ และที่แก้ไขเพิ่มเติม ซึ่งการเปิดเผยดังกล่าวจะกระทำได้ก็ต่อเมื่อผู้แจ้งเบาะแสให้ข้อมูลส่วนบุคคลในการติดต่อกลับเท่านั้น ทั้งนี้เป็นไปเพื่อช่วยเหลือผู้เสียหายจากการค้ามนุษย์ให้มีประสิทธิภาพมากที่สุด
8. สิทธิของเจ้าของข้อมูลส่วนบุคคล
ความยินยอมการใช้งานข้อมูลส่วนบุคคลที่ผู้ใช้งานให้ไว้กับ กคม. สามารถเพิกถอนความยินยอม หรือระงับการใช้ หรือเปิดเผยข้อมูลส่วนบุคคล โดยส่งคำขอของผู้ใช้งาน หรือเจ้าของข้อมูลส่วนบุคคล แจ้งให้ทาง กคม. ทราบเป็นลายลักษณ์อักษร หรือผ่านทางจดหมายอิเล็กทรอนิกส์ [email protected] หรือ [email protected]
อนึ่ง ทาง กคม. ไม่ได้มีข้อขัดข้องในการเพิกถอนความยินยอมจากผู้ใช้งาน แต่ทั้งนี้การดำเนินการอาจมีข้อจำกัดสิทธิในการเพิกถอนความยินยอมโดยกฎหมาย หรือสัญญาที่ให้ประโยชน์แก่เจ้าของข้อมูลส่วนบุคคล รวมถึงการดำเนินการเพิกถอนฯที่ไปขัดกับกฎหมายใดกฎหมายหนึ่ง ซึ่งทาง กคม. จะมีการชี้แจงเป็นลายลักษณ์อักษรไปยังผู้ใช้งานให้ทราบอีกครั้งหนึ่ง
9. การรักษาความมั่นคงปลอดภัยและความลับของข้อมูลส่วนบุคคล
กคม. มีมาตรการการรักษาความมั่นคงปลอดภัย เพื่อป้องกันไม่ให้เกิดการเปิดเผยข้อมูลส่วนบุคคล หรือจัดการข้อมูลส่วนบุคคลโดยมิชอบ โดยมีแนวปฎิบัติตั้งแต่การกำหนดสิทธิในการเข้าถึงข้อมูล หรือการใช้ข้อมูลส่วนบุคคล รวมถึงกระบวนการตรวจสอบย้อนกลับของการเข้าถึงข้อมูลฯ อย่างไรก็ตามเพื่อธำรงไว้ซึ่งความลับ (confidentiality) ของข้อมูลส่วนบุคคล ทาง กคม. ยังได้กำหนดขั้นตอนการทบทวนอยู่เป็นระยะ เพื่อให้มั่นใจได้ว่ามีความรัดกุมและมีประสิทธิภาพเพียงพอ
10. นโยบายข้อมูลส่วนบุคคลเพิ่มเติม และข้อตกลงสำคัญ
ทาง กคม. ขอให้ผู้ใช้งานโมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” อ่านและทำความเข้าใจกับนโยบายความเป็นส่วนตัวนี้อย่างครอบคลุม ครบถ้วนก่อนการใช้งาน รวมถึงข้อตกลงอื่นใดที่ไม่ได้ปรากฏอยู่ในนโยบายฯนี้ แต่มีปรากฎอยู่ในโมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” ซึ่งจะถือว่ามีผลผูกพันในทางกฎหมายเมื่อเข้าใช้งาน ทั้งนี้เมื่อผู้ใช้งานได้อ่านและทำความเข้าใจอย่างรอบคอบแล้วให้กดปุ่มยอมรับที่ปรากฎในโมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U” ซึ่งมีความหมายว่าผู้ใช้งานได้ให้ความยินยอมในการประมวลผลข้อมูลส่วนบุคคลของผู้ใช้งานตามนโยบายฯนี้ หากผู้ใช้งานไม่เห็นด้วย ผู้ใช้งานต้องยกเลิกการใช้งานโมบายแอปพลิเคชัน “โพรเทคยู/PROTECT-U”
11. การปรับปรุงนโยบายการคุ้มครองข้อมูลส่วนบุคคล
กคม. ขอสงวนสิทธิ์ในการปรับปรุง เปลี่ยนแปลง หรือแก้ไขนโยบายคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ได้ในอนาคต โดยการแก้ไข หรือเปลี่ยนแปลงจะคงอยู่ภายใต้ข้อบังคับของกฎหมาย ซึ่งทาง กคม. จะประกาศให้ทราบทางเว็บไซต์ www.e-aht.com
12. การปฏิบัติตามนโยบายคุ้มครองข้อมูลส่วนบุคคลและการติดต่อกับสำนักงาน
ในกรณีที่ผู้ใช้งานมีข้อสงสัย หรือข้อเสนอแนะเกี่ยวกับนโยบายการคุ้มครองข้อมูลส่วนบุคคลหรือการปฏิบัติตามนโยบายการคุ้มครองข้อมูลส่วนบุคคลฉบับนี้ กคม. ยินดีรับฟังข้อเสนอแนะ และตอบข้อสงสัย เพื่อประโยชน์ต่อการปรับปรุงการคุ้มครองข้อมูลส่วนบุคคล โดยผู้ใช้งานสามารถติดต่อผ่านทางจดหมายอิเล็กทรอนิกส์ [email protected] หรือ [email protected] หรือตามที่อยู่ด้านล่างนี้

Privacy Policy
1. Definition
DATIP stands for Division of Anti Trafficking in Persons which is a division under Permanent Secretary Office of MSDHS.
Mobile Application Protect-U stands for mobile application developed by DATIP as a tool to facilitate the individuals to report the trafficking incidents witnessed in Thailand for assistance to the official or the relevant agency, allow its user to educate themselves on their rights if they become a victim of trafficking, request an interpreter or interpreter evaluation and purchase products made by victim of trafficking who’s under MSDHS’s protection on Android and iOS devices.
Owner of Personal Data means those who owns their own information which they used to access mobile application Protect-U and the policy dictates this definition as “user” or “notifier”.
Personal Data means personal information which can be used to identify a person whether directly or by other means as dictated by Personal Data Protection Act 2019.
2. Acquisition of Personal Information
2.1 Mobile application Protect-U collect information regarding report of human trafficking indicator through the marker on the GPS map and nearby location and information regarding the individual who filed the report. However, the information regarding the individual will not be collected if the individual does not wish it so as the data collection is not a must or must be given.
2.2 When requesting an interpreter, the application will collect data regarding the interpreter(s), operating location and data regarding related coordinator(s).
2.3 Evaluation of an interpreter will collect data regarding the evaluator and the evaluated.
3. Purpose of Personal Information Processing
Procession of the collected data will evaluate the report on trafficking situation in summary regarding the map design and interpreter statistics for the purpose of further application updates and personal information will not be included in the evaluation but will be utilized to coordinate efforts between related organizations for the right to the provisions of necessary benefits of victim of trafficking.

6. Data Collection Duration and Personal Information Storage Location
DATIP will collect personal information as necessary while considering the purpose and its necessity in process for the benefit of victim of trafficking and human trafficking statistics evaluation.
DATIP will be on-premise with the data and act in confidentiality in accordance with administrative, technical and physical access safeguard regarding access and control of personal data, as follows:
(1) Control the access to personal information and access to individual information collection and evaluation equipment while considering their utilization and security.
(2) Provision regarding individual information access authorization such as only authorizing those who are under the mandate to protect personal information for access as a safety measure against information leak.
(3) Manage user access to ensure that personal information can only be accessed by those who are authorized.
(4) Mandate user responsibilities as a safeguard against unauthorized access, broadcast, discovery creation of unauthorized copy of personal information or theft of collection and evaluation equipment.
(5) Develop access to old information regarding access, changes, delete or transfer of personal information to suit related process and media used to collect, utilize or broadcast personal information.
7. Disclosure of Personal Data
DATIP may specifically disclose personal data of the individual to government agencies responsible for follow-up, arrest and prosecution if there is an evidence that an offence of trafficking in persons has been committed according to the Anti-Trafficking in Persons Act, B.E.2551 (2008) and additional amendment. Therefore, the disclosure can be made when the individual has provided personal data to contact back only. This is to help the victims of trafficking in the most effective way.
8. Rights of Personal Data Owners
The user has the right to withdraw data privacy compliance that they give to DATIP, or suspend the use of application or the disposure of their personal data by sending a user request or personal data to DATIP with written notice or via electronic mail: [email protected] or [email protected].
Furthermore, DATIP has no objection to the withdrawal of consent from the user. However, there may have limitation on rights to withdraw consent as required by the law, or contact beneficial to owner of personal data including the withdrawal process that is against other laws. Thus, DATIP will once inform with written notice to the user.
9. Maintaining Security and Confidentiality of Personal Data
DATIP has security measures in order to prevent the disclosure or improper management of personal data by determining the rights to access data or the use of personal data as well as the process of data traceability. On the other hand, to maintain confidentiality of personal data, DATIP has periodically determined review procedure to ensure that the process contains enough conciseness and effectiveness.
10. Additional Privacy Policy and Significant Agreement
DATIP has requested the user who uses PROTECT-U application to comprehensively read and understand with the Privacy Policy before accessing. Moreover, the any agreement that does not appear in this policy, but in mobile application, PROTECT-U, will be considered to be a legal binding when accessing the application. In addition, when the user has concisely read and understood, please press the accept bottom, meaning that you give a consent to processing personal data as in the policy. If the user does not agree, they have to cancel the use of mobile application.
11. Privacy Policy Amendment
DATIP would like to reserve the right to amend, change or modify the Privacy Policy in the future. Furthermore, the amendment or change will be under the law which will be declared via website: www.e-aht.com.
12. Privacy Policy Compliance and Contact with the Office
If the user has any questions or suggestions about Privacy Policy or Privacy Policy compliance, DATIP is willing to hear your suggestions and answer your questions for the benefits of amending personal data protection.
